Public Offer - Transfer Services Agreement

Company: Transstream Sp. z o.o., registered at Bokserska 64/302, 02-690 Warsaw, Poland, NIP: 9512540804 (hereinafter - the Company)

By using the transfer services offered on the website of the Company, you (hereinafter - the Customer) accept this public offer and agree to the following terms and conditions:

1. SUBJECT OF THE OFFER

  • 1.1. The Company provides transfer services from the price list available on the Company's website or according to an individually agreed route (hereinafter - the Services).
  • 1.2. The Customer can book the Services via the Company's website, Personal Account, or other booking channels provided by the Company.
  • 1.3. A completed transfer is a passenger vehicle or other transport provided by the Company, fully paid and properly executed.

2. RIGHTS AND OBLIGATIONS

  • 2.1. Obligations of the Company:
    • Provide the Services on time and in accordance with the agreed conditions;
    • Provide a vehicle of the appropriate class and condition as indicated in the price list;
    • Ensure confidentiality of the Customer's data;
    • Provide tracking of the trip and assistance in case of route changes.
  • 2.2. Obligations of the Customer:
    • Provide accurate data for booking (name, contact, pick-up location and time);
    • Pay for the Services in the terms and methods specified by the Company;
    • Follow the rules of conduct while using the vehicle;
    • Notify the Company in advance of any changes in the booking.
  • 2.3. Rights of the Customer:
    • Receive the Services according to the booking conditions;
    • Request changes to the route or time, if possible;
    • Receive confirmation of booking and payment receipts.

3. PRICE AND PAYMENT

  • 3.1. The price of the Services is determined by the Company's website price list or agreed individually.
  • 3.2. Payment can be made online through available payment systems or other methods agreed by the Parties.
  • 3.3. In case of cancellation by the Customer, refund is governed by the Cancellation and Replacement Policy (see Section 8).

4. LIABILITY

  • 4.1. The Company is not responsible for delays or changes due to circumstances beyond its control (force majeure, road conditions, third-party actions).
  • 4.2. The Customer is responsible for any damage caused to the vehicle or Company property.
  • 4.3. Both Parties are exempt from liability in case of force majeure (fire, flood, earthquake, war, epidemics, etc.).

5. CONFIDENTIALITY

  • 5.1. Both Parties agree not to disclose any information received in connection with this Agreement to third parties without written consent.

6. TERM AND TERMINATION

  • 6.1. The Agreement enters into force upon confirmation of the booking by the Customer and remains valid until all obligations are fulfilled.
  • 6.2. The Agreement can be terminated by mutual consent or unilaterally in cases provided herein.

7. DISPUTE RESOLUTION

  • 7.1. All disputes are to be resolved through negotiations between the Parties.
  • 7.2. If the dispute cannot be resolved amicably, it shall be submitted to the competent courts of Poland.

8. CANCELLATION AND VEHICLE REPLACEMENT

  • 8.1. Cancellation by the Customer
    • 8.1.1. The Customer may cancel a booking via Personal Account, website, or Company support.
    • 8.1.2. Cancellation more than 24 hours before the scheduled pick-up time entitles the Customer to a full refund or credit for future trips.
    • 8.1.3. For early bookings (made more than 14 days in advance), if cancellation occurs less than 24 hours before pick-up, 50% of the price will be refunded.
    • 8.1.4. For standard bookings canceled less than 24 hours before pick-up, the Company reserves the right to charge partial payment (e.g., 50% of the trip cost).
    • 8.1.5. In case of no-show without prior notice, the full cost is forfeited.
  • 8.2. Vehicle Replacement by the Company
    • 8.2.1. In case of force majeure or technical reasons, the Company reserves the right to replace the vehicle with another of the same class at no additional cost to the Customer.
    • 8.2.2. The Company will inform the Customer as soon as possible and ensure equivalent trip conditions.
  • 8.3. Exceptions and Special Conditions
    • 8.3.1. Special orders (VIP transfers, customized routes, additional services) may have separate cancellation/replacement conditions agreed during booking.
    • 8.3.2. For repeated booking changes, the Company may adjust the service cost according to its expenses.

9. FINAL PROVISIONS

  • 9.1. This Agreement is drafted in English.
  • 9.2. The Agreement is governed by the laws of Poland.
  • 9.3. This Agreement constitutes the entire understanding between the Customer and the Company regarding the transfer services

By booking and using the Services, the Customer fully accepts this public offer.
